1. Acceptance of Terms
By registering, accessing, or using Faka (the "Platform" or "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Faka provides a compatible AI API gateway infrastructure for OpenAI (Chat Completions, Responses) and Claude (Anthropic Messages) API protocols. The Service handles account-pool routing, request-level observability, upstream error isolation, and transparent token cost tracking.
3. Account Registration & API Key Security
You must create an account and obtain API credentials ("API Keys") to access the Platform. You are solely responsible for maintaining the confidentiality of your API Keys and for all activities that occur under your credentials. You must immediately notify us of any unauthorized use of your account.
4. Acceptable Use Policy & Restrictions
You agree not to use the Platform to:
- Generate, transmit, or distribute content that violates applicable laws or regulations;
- Attempt to bypass, disable, or interfere with security controls, account-pool routing, or rate limits;
- Conduct denial-of-service attacks, port scanning, or malicious automated requests against upstream AI providers or Faka infrastructure;
- Resell, sublicense, or redistribute API access without proper authorization.
5. Billing & Refund Policy
Faka calculates charges based on official model reference prices multiplied by your group’s published discount factor. Account balances or credits are deducted according to published rules visible in your Console.
- Refund Eligibility: Unused USD balances or credits are eligible for a full refund within 7 calendar days of payment if requested prior to API consumption. Balance amounts already spent on completed API request tokens are non-refundable.
- Refund Application Process: To request a refund, please send an email to our customer support team at lucklycaicai@gmail.com with your registered account email, payment order ID, and reason for refund.
- Processing & Arrival Timeframe: Our support team will review your request within 1 to 3 business days. Approved refunds will be credited back to your original payment method within 1 to 5 business days, depending on payment providers.
6. Data Ownership & Intellectual Property
You retain all ownership rights to the prompts, inputs, and outputs transmitted through the Service. Faka does not claim ownership over your data or generated content. All platform software, gateway logic, and trademarks remain the property of Faka.
7. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. FAKA DOES NOT GUARANTEE UNINTERRUPTED AVAILABILITY OR SPECIFIC RESPONSE TIMES FROM THIRD-PARTY UPSTREAM AI PROVIDERS (SUCH AS OPENAI OR ANTHROPIC). IN NO EVENT SHALL FAKA BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.
8. Termination & Service Modifications
We reserve the right to suspend or terminate accounts that violate these Terms, or to modify, suspend, or discontinue any aspect of the Service with reasonable notice when feasible.
9. Governing Law
These Terms shall be governed by and construed in accordance with applicable legal frameworks, without regard to conflict of law principles.
